カナダの医薬用途発明
カナダはユニークです。
経験するところによると、医薬用途発明を、治療方法でクレームすると、non-statutory subject matterとして拒絶されます。
ここまでは、欧州特許庁や日本とも、結論としては同じです。その理由が、不特許事由であったり、産業上利用可能性であったりするとしても。。。
では、どのようにクレームを書き直すべきか、ということになりますが、カナダでは、
(1)製造のための使用に向けられたUseクレーム
Use of Compound X for the manufacture of a medicament to treat disease Y
だけではなく、
(2)医薬用途そのものに向けられたUseクレーム
Use of Compound X to treat disease Y
欧州特許庁でも日本でも、この(2)のクレームまで許されません。これは、治療方法と同じ意味と考えられているからです。カナダで、この(2)のクレームまで許されていることまで深く探究していませんが、その発想の違いは、ステップが記載されているかか否がに起因するようです。したがって、単にmethodとuseという形式で区別されるのではなく、実質的に考えなければならず、useではじまっていても、ステップが記載されていれば、methodと同様に扱われることもあります。
カナダの審査基準MOPOP(Manual of Patent Office Practice)の12.06.08には、以下の記載があります。
A use is distinguished from a method in
that the latter involves directing the person skilled in the art to take a step
or series of steps to arrive at the desired result. In contrast, a use must not
require any specific step or steps to be followed. Rather, a use is defined
only in terms of the means to be applied, the circumstances of this
application, and the result to be achieved. The "how" of implementing
a use must be left to the common general knowledge of the person skilled in the
art. A claim that purports to be a use claim (e.g. a claim that begins
"the use of") but that defines specific steps to be followed is, in
effect, a method and must be examined as such.

Where the distinction between methods
and uses is important is in fields where a method would be non-statutory but a related use would be statutory. This situation relates particularly to the
pharmaceutical fields, where a method of treating a patient by some means is non-statutory but the use of a
means in the treatment of a patient is statutory. Thus, a claim to "a
method of treating a patient having disease Y, comprising administering to said
patient drug X" is an excluded method of medical treatment, whereas the
claim "the use of drug X to treat disease Y" would be considered
statutory.
ちなみに、(1)のクレームは、欧州生まれで、スイス型クレームといわれますが、欧州特許庁では、禁止されました。EURO2000の下では、必要がなくなったから、という理由です。日本の特許庁は、もともと、(それほどの)必要がなかったのに、認めていたのですが、それ故に、なくすことは難しいようです。まあ、それほど、あせって、禁止するほどのものでもないとはおもいますが。。。
カナダでは、その他に、用途限定付きの化合物・組成物のクレームが認められているようです。
ただ、カナダでは、どのクレームフォーマットにするにせよ、治療的なステップをいれると拒絶される可能性が高まるようです。標語的には、「for administration」はいいが、「is administered」はいけません、などといわれることがあるようです。この辺りのさじ加減は、審査官にもよりますので、走りながら考えるしかないところもありますが。。。
こういう細かいところにも気にしながら、実務をするのは、気を使いますが、ちょっとの工夫で、各国でベストな権利化を図ることができるので、面白いといえば、面白いです。
